Under the Illinois Gestational Surrogacy Act of 2005, when a gestational Surrogate gives birth in Illinois, parental rights immediately pass to the Intended Parents. This eliminates the need for the Intended Parents to go through the adoption process after birth since the names of the Intended Parents are entered on the child’s birth certificate.
